Areas of practice
Sebastian specialises in Chancery and commercial law, with a particular emphasis on disputes about land. His areas of practice include:
- All aspects of landlord and tenant law (commercial, agricultural, and residential)
- Easements and freehold covenants
- Boundary disputes and adverse possession claims
- Trusts of land and proprietary estoppel
- Unlawful interference with land (nuisance, trespass)
- Mortgages
- Land registration
- Disputes about contracts for the sale of land (or grant of an interest in it)
- Insolvency (particularly its impact on property rights and obligations)
- Professional negligence claims against solicitors, surveyors and estate agents.
He appears before a variety of tribunals including the High Court, County Courts and the Adjudicator to HM Land Registry, and has considerable experience of alternative forms of dispute resolution such as mediation and arbitration.
Sebastian previously worked as an employed barrister in the highly regarded real estate disputes team at Mills & Reeve LLP where he worked on a number of reported cases including Norwich City College of Further and Higher Education v McQuillin and Anor (2009) 27 EG 90 (CS) (application under section 84(2) Law of Property Act 1925 for a declaration concerning the enforceability of a restrictive covenant) and Shirley v Crabtree [2007] 1 WLR 18 (appeal by way of case stated to the Administrative Court from the Agricultural Land Tribunal) .
In 2004 he was the judicial assistant to the Chancellor of the High Court for two terms.
