Issues arising in members of chambers’ insurance work have
included coverage (including avoidance or termination of covers
for non-disclosure or misrepresentation, and the construction of
policies and treaties), notification problems, and questions of
illegality or fraud. Members also appear in arbitrations involving
insurance and reinsurance disputes. Members of chambers frequently
act for insureds, insurers, reinsurers and intermediaries.
The work done extends over different classes of insurance (e.g.
aviation, bloodstock, business interruption, cargo in transit, contractors’
risks, credit risks, energy, fidelity, fire, liability, life assurance,
marine, medical, political risks, professional negligence, property,
protection and indemnity and space/satellite risks) and reinsurance
risks (e.g. excess of loss, facultative, quota share, stop loss
and financial reinsurance).
Individual Members have extensive practical experience of the Lloyd’s
Names’ and Companies' markets in London. Members were involved
in the Lloyd's litigation, and acted in disputes between Lloyd’s
syndicates, managing agents and intermediaries in relation to issues
concerning the Insurance Mediation Directive. Members also advise
on the setting up of insurance companies, compliance with statutory
and other regulatory requirements, and the drafting and interpretation
of insurance policy wordings.
