Areas of practice

Having been called to the bar in 2009, Hugh practises across a wide range of commercial chancery matters at 13 Old Square, almost all of which are contentious. Although his work tends focus on commercial litigation, company law and insolvency matters, Hugh is equally happy to accept instructions in Chambers’ other core areas of work, including property, trusts and professional negligence. 

Hugh is especially comfortable as an advocate, and regularly appears in the County Courts and High Court. Hugh has recently been instructed in a number of urgent and ex parte applications, and is happy to assist on matters at short notice. He is also frequently instructed to produce drafting and advisory work.

Insolvency and Company Law

Hugh has experience in a number of core areas of both personal and corporate insolvency work, and has acted for a variety of clients including major London Insolvency Practitioners. Recent work includes both contested and uncontested bankruptcy and winding up petitions; applications to set aside antecedent transactions; setting aside of statutory demands and the annulment of bankruptcy orders. Hugh has previously considered the application of cross-border insolvency regulations in English law and has recently acted for a Trustee in relation to obtaining property in Morocco. He has also acted in applications for validation orders, administration and the appointment of provisional liquidators and in emergency applications restraining presentation and advertisement of winding up petitions.

Hugh was recently instructed as sole counsel for a liquidator in a 5 day trial in the High Court in an application for wrongful trading (s.214 IA). Hugh also has experience of company law issues, such as director and/or shareholder disputes, s.994 petitions for unfair prejudice and claims against directors for breaches of statutory and fiduciary duties.

Commercial and Civil Fraud

A significant proportion of Hugh’s work consists of contractual disputes and associated applications, both in an advisory role but more frequently as an advocate. Hugh has recently been instructed in relation to valuable fraud claims and assisted in a Court of Appeal matter relating to tortious conspiracy. Hugh has a keen interest in the international aspects of commercial work, which has included jurisdictional and choice of law issues in commercial litigation. Hugh has been instructed in a number of interim applications in the High Court in relation to on-going commercial disputes.

 Property, Trusts and Estates

Hugh’s experience in property matters includes landlord and tenant disputes, possession claims, and real property litigation. Trusts work during practice and pupillage have included claims under the Insolvency Act 1975 and claims for breach of trust and/or fiduciary duties. Hugh assisted in off-shore trust litigation during pupillage in which he considered the liability of the corporate trustee of a large multi-jurisdiction trust in relation to intra-trust loans.

Torts and Professional Liability

Hugh has recently been instructed in relation to claims in nuisance and trespass relating to commercial premises. He also has experience of professional negligence, particularly in relation to claims against solicitors, IFAs and surveyors. Most recently, Hugh was instructed as a junior to Michael Booth QC in relation to a 15 day trial in the Solicitors Disciplinary Tribunal.

Education

Hugh read law at Gonville and Caius College, Cambridge where he held both academic and choral scholarships. Finishing in the top 10% of his year in both second and final years, he was awarded the Tapp Postgraduate Scholarship and the 3 Verulam Buildings Prize for the highest mark in the University for the Trusts and Equity paper. Hugh was the winner of the Brick Court Team Mooting Competition in 2008. Hugh undertook his BVC at BPP Law School where he was awarded an ‘outstanding’ grade, finishing with the joint highest mark in his year. 

Personal

Hugh has been a singer for many years and continues to perform in choirs and as a soloist whenever possible. He enjoys listening to a range of music, particularly choral, opera and jazz.

Hugh also enjoys playing badminton and, weather permitting, cricket. Other interests include travelling and reading.
